Notice of filing COURT ORDER (19 June 2024)

IT IS ORDERED THAT:

  1. This matter is declared to be urgent and the Applicant is granted condonation against strict compliance with the provisions of Rule 6(12) of the Uniform Rules of this Court regarding service.
  2. The 1st to 3rd Respondents be and are hereby interdicted from inciting violence against the Principal of the College, making security threats to him, holding him hostage and terrorizing his office.
  3. The 1 st to 3rd Respondents be and are hereby interdicted from interfering with the induction process that is set to take place on the 24-27b June 2024 at the main campus of the Applicant in Cicirha.
  4. The 1st to 3rd Respondents be and are hereby directed to instruct its members to refrain from inciting violence and from disturbing the induction process as the political leaders that is set to take place on the 24th -27th June 2024 at the main campus of the Applicant in Cicirha.
  5. The 1st to 3rd Respondents be and are hereby interdicted from sending mass messages for purposes of caucusing intended strike action.
  6. The 1st to 3rd Respondents be and are hereby interdicted from inteith 09th

Respondents in the discharge of its constitutional duties.

  1. It is declared that the 1st and 2nd Respondents are not eligible to run for SRC

Office by reason of Sections 10 and 11 of the SRC Constitution.

  1. The orders 1-7 shall operate as interim orders.
  2. A rule nisi hereby issues to the 25th of June 2024 why orders 1-8 hereto above should not be made final.
  3. Granting leave to members of the South African Police Service to forthwith arrest the 1 st and 2nd Respondents in the event of breach / contempt of the interim order.Granting the Applicant leave to serve a copy of this application and supporting affidavits upon the 1st and 2nd Respondent's Attorneys of record electronically to hrnzima2 0.omail.com in the event of service being impossible over the weekend.
  4. Directing the 09th Respondent to circulate a copy of this application, supporting affidavits, interim order, rule nisi and final order to all interested stake-holders immediately forthwith by way of email or other appropriate medium.
  5. Granting the Applicant leave to serve a copy of this application ad interim order upon the 4th to IOh Respondents by placing it upon the Applicant's main notice board the Cicirha Campus through the Sheriff.
